General Terms and Conditions (Terms & Conditions) of

Cantina I Fracc – ONLINE SHOP

The general terms and conditions are the basis for a fair customer relationship. By sending an order the customer agrees to the general terms and conditions. We do our utmost to serve our customers according to their needs and to their complete satisfaction. To ensure that the general terms and conditions remain legible, we use the masculine form, but of course we also address female customers.

These General Terms and Conditions (GTC) govern the relationship between Cantina I Fracc, I Fracc 26a, 6513 Monte Carasso (hereinafter referred to as “ifracc”), and you as ifracc customer (hereinafter referred to as “customer” or “you”). Deviating agreements must be in writing to be valid.

Our entire offer of www.ifracc.ch is directed to a clientele within Switzerland and the Principality of Liechtenstein. There are no deliveries abroad.

The offer to conclude a contract is made by you as a customer by clicking on the button “Complete order” after you have completely filled out the order page. You are bound to the order for one week. The contract is binding if we accept the order within this period in accordance with the following provisions.

After sending the order, you will receive an automated e-mail with which we confirm receipt of the order (order confirmation). The order confirmation serves only to inform you that we have received the order.

A contract is only valid when we declare the acceptance of the contract. We declare the acceptance of the contract by issuing an invoice to the customer, confirming the order (order confirmation), confirming by e-mail that the goods have left our warehouse (shipping confirmation) or at the latest by delivering the goods.

The contract is only concluded for those items that are expressly listed in our invoice, order confirmation or shipping confirmation. This also conclusively determines the scope of services.

The customer has the possibility to print out the order and the entered data during the ordering process. Furthermore there is the possibility to open a customer account. In the customer account the order data can be viewed after entering the personal access data. I Fracc reserves the right to block customer accounts at its own discretion without giving reasons.

I Fracc does not sell alcohol to minors under the age of 18. By placing an order on www.ifracc.ch, the customer confirms the accuracy of his information and thus his right to purchase.

6.1 Definition end customer

The conditions under item 6 apply to private individuals and companies domiciled in Switzerland or the Principality of Liechtenstein as end users.

6.2 Prices

All prices are per item in Swiss Francs. Price changes as well as time-limited promotions are possible at any time and do not require prior notice. Net articles are marked with “n” or “net”.

6.3 Payments

Payment of the purchase price will be made by invoice, if provided and available on the website.

If I Fracc accepts payment of the purchase price by invoice, the purchase price is due within 10 days of the invoice date. A default interest of 5% will be charged for late payments. Reminder fees will be charged at a flat rate of CHF 20.

When purchasing on prepayment, the desired order will only be triggered when the corresponding payment has been received. The items in the order cannot be reserved. If payment is not received by IFracc within 10 days, the order may be cancelled by I Fracc.

The goods remain the property of I Fracc until the invoice has been paid in full.

6.4 Delivery & Shipping Costs

In the event of force majeure such as strikes and other industrial action, riots, war and natural disasters, there will be no delay in delivery. I Fracc is not liable for delivery delays caused by third parties.

Should not all ordered goods be in stock, we are entitled to make partial deliveries. Should it become apparent after conclusion of the contract that goods cannot be delivered either in part or in whole for reasons for which the vendor is not responsible, the customer is entitled to withdraw from the contract.

In addition, I Fracc reserves the right to adjust the quantities ordered after confirmation of receipt of the order, especially in the case of articles with limited availability.

Delivery is made to the invoice recipient or to a delivery address of his choice in Switzerland or the Principality of Liechtenstein. In principle, the ordered goods will be delivered on our behalf by lorry, post or vinolog according to the following cost regulations:

– Deliveries with a value of CHF 100 or more are made free domicile.
– For deliveries under CHF 100, a flat rate of CHF 20 will be charged.
– In the case of express deliveries, the actual costs incurred will be charged to the customer.

Quantities of up to 30 bottles are generally delivered by mail or Vinolog. The goods will be delivered as soon as possible.

Our service is a debt of fate and is fulfilled with the handover to the transport person. After dispatch, the risk of accidental deterioration and accidental loss of the goods passes to the customer. We are not responsible for any fault of the transport company used.

6.5 General availability

Our assortment (products, vintages etc.) is subject to constant change. We reserve the right to make short-term changes to the assortment and/or vintage. A complete and constant availability of our offer on www.ifracc.ch can therefore not be guaranteed.

6.6 Limited availability of articles including rarities

Our assortment also includes wines and spirits of limited availability or items where demand exceeds supply. On the one hand, this means an upgrading of our assortment, on the other hand this shortage can make it difficult to allocate such wines to our customers. It is our task and policy to ensure a distribution that is as fair as possible, not speculative, throughout Switzerland. We ask for your understanding for this.

6.7 Warranty

The quality of the received goods must be checked immediately after receipt; after eight days the delivery is considered approved.
